2. PURPOSE

This Legal Notice regulates the access, navigation and use (i) of the website located at the URL https://equito.app (the "Website"), as well as (ii) of the Equito mobile application (the "Application") (both the Website and the Application called hereinafter the “Platform”), and by means of which we inform users about their rights and obligations in relation to the contents shown in both, as well as to the logos and trademarks used, and the responsibilities that may arise from their use.

 

The access, navigation or use of the Website or the Application implies the express and unreserved acceptance of all the terms of this Legal Notice, having the same validity and effectiveness as any written and signed contract.  Without prejudice to the above, Equito reserves the right to modify the presentation, configuration and content of the Website and the Application, as well as the present Legal Notice.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

Equito is the owner or, whenever appropriate, has the corresponding licenses over the intellectual, industrial, images or any other analogous property rights over the Website and the Application, as well as all the contents offered therein, including, but not limited to, photographs, illustrations, logos, brands, graphics, designs, interfaces, or any other information or content included. 

 

Users have a non-exclusive right of use, strictly within their personal environment and with the only purpose of browsing the Website and the Application in congruence with this Legal Notice.

4. USER OBLIGATIONS

It is not permitted and therefore its consequences will be the sole responsibility of the users, the access or use of this Website or its Application for illegal or unauthorized purposes, with or without economic purpose. In particular, and without limitation to this list, it is prohibited to:

 

(i) use the Website or the Application in any way that may cause damage, interruption, inefficiency or defect in the operation of the Website or the Application or third-party devices;

 

(ii) use the Website or the Application for the transmission, installation or propelling of any virus, Trojan horse, worm, malicious code or other harmful or unlawful programs or files;

 

(iii) use the Website or the Application to transmit material for advertising or promotional purposes, including spam, chain letters or similar, without the prior express written permission of Equito;

 

(iv) use the Website or the Application in a manner that constitutes an infringement of any rights of Equito or any third party;

 

(v) use the Website or the Application to transmit or publish any material of a defamatory, offensive, racist, vulgar, denigrating, pornographic, or obscene or threatening nature or which may annoy, harm or merely affect any person in the opinion of Equito;

 

(vi) use the Website or the Application to collect personal data from other users;

(vii) use the Website or the Application in an unlawful manner, contrary to good faith, morals and/or public order;

 

(viii) access any part of the Website or the Application, or other systems or networks connected to them, without authorization, as well as accessing any Equito server or the services offered through the Website or the Application by hacking or forgery, password mining or any other means which is unlawful or set out in this Legal Notice;

 

(ix) carry out any action which causes disproportionate or unnecessary saturation to the infrastructure of the Website or the Application or to the systems or networks used or owned by Equito, as well as to the systems and networks connected to the Website and the Application.

 

Failure by users of the Website or the Application to comply with any of the above obligations may lead to the adoption by Equito of appropriate measures under the law and in the exercise of its legitimate interests.

5. EXCLUSION OF LIABILITY

Equito cannot guarantee the reliability, usefulness or truthfulness of absolutely all the information contained in the Website and the Application, nor the usefulness or truthfulness of the contents made available to users through them.

Consequently, Equito does not guarantee nor is responsible for:

(i) the continuity of the contents of the Website or the Application;

(ii) the absence of errors in such contents;

(iii) the absence of viruses, trojans, worms and/or other malicious or technologically harmful components in the Website or the Application or the server that supplies them;

(iv) the invulnerability of the Website and the Application and/or the impossibility of breaching the security measures taken therein;

(v) the lack of usefulness or performance of the contents of the Website or the Application;

(vi) the failure of the Website or the Application caused by any attack to its servers or those servers of third-party service providers, as well as technical or system security failures of any of the providers which prevent the Website and Application’s proper functioning;

(vii) any technical failure, of any kind, that hinders, delays or prevents the proper functioning of the Website or the Application;

(viii) any damage or harm caused, to yourself or a third party, by any person who infringes the conditions, rules and instructions set out by Equito on the Website and the Application or through the violation of security systems.

Equito declares that it has adopted all the necessary measures within its possibilities and the state of the art, to guarantee the functioning of the Website and the Application and to minimize the system errors, both from a technical point of view and by reviewing the contents published on the Website and the Application. 

Equito is not responsible for the accuracy, completeness or the updating of the information published on the Website or the Application from sources outside the Website, nor for the information contained in other platforms linked to the Website or the Application.

Equito reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, the access, navigation, use, hosting and/or downloading of the content and/or use of services of the Website and the Application, with or without prior notice, to users who violate any of the provisions detailed in this Legal Notice, without the possibility of demanding compensation for this cause. 

6. USER SUPPORT

The users have at their disposal the user service by which Equito will attend to the queries, complaints and suggestions made by them.

Equito will respond to the complaints or queries as soon as possible and in any case within a maximum period of one (1) month.

7. CONFIDENTIALITY AND DATA PROTECTION.

In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of individuals in regards to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC ("GDPR") as well as the Organic Law 3/2018, of December 5, Protection of Personal Data and guarantee of digital rights ("LOPDGDD"), all personal data provided during the use of the Website or the Application will be treated in accordance with the provisions of the Privacy Policy that users must read and, where appropriate, accept and/or consent.

8. SAFEGUARD CLAUSE

All the clauses or extremes of this Legal Notice must be interpreted independently, in case one of them has been declared null and void by a court sentence or final arbitration resolution, the rest of the clauses will not be affected. The affected clause or clauses will be replaced by another or others that preserve the effects pursued by this Legal Notice.

9. APPLICABLE LEGISLATION AND JURISDICTION

The regulations in force will determine the laws that the parties must comply to and the jurisdiction that regulates the relations between Equito and the users of the Website or the Application. However, for any litigious matter derived from or related to this Platform, if the above stated regulations oblige the intervening parties to submit to a specific jurisdiction, the valid Spanish legislation at the time of the litigation will be applicable.
